Question by arabieamanda: my ex-husband owes back child support of 12,000+dollars as of October. how do i receive the tax return?
how do i receive or go about contacting the IRS about getting the money. He is only paying 100 dollars towards arrearages and calculating that amount. it will take approx. 8 years r more to receive it.
these arreagages are for my special needs child as this money covers her medical payments which he agreed to pay at divorce because he DROPPED her on his insurance! in response to previous answers, yall all dont know whats goin on, so instead of giving negative feedback, yall need to educate yourselves in this matter. thank for all support:)

I think he’s allowed to make payments like that until he’s caught up. He should be allowed to keep enough to live on himself.

There is nothing that you can do personally, the IRS and the State should work together to deduct his tax returns accordingly.
If the $ 100 towards arrears was court ordered then he is doing his part in an attempt to pay it back. You should be happy, in the state I live in, there is a program for non custodial parents called Fresh Start. If they owe more then $ 7000.00 in child support then the slate is wiped clean and they start at zero!!!

IRS does not collect, pay or distribute child support.
Child support is not tax deductible and it is not considered income. The IRS has nothing to do with it either way.
Contact your local family court officer for help in filing the appropriate forms to obtain/modify your support.
Knowledge is power… get smart about the system, and you will save yourself, your ex, and your kids a whole pile of crappola.
And, of course, you could just take on the adult responsibility of caring for yourself and your kids… and write your ex off as bad business. (Not in the tax sense… this still has nothing to do with the IRS)
If they made that arrangment for him to pay in court than thats about it, he’s makin an effort…it sucks believe me. You can file something with the childsupport and see if they can reevaluate payments.
Unless he allows them to take his income tax for payment, then I dont think there is a way to have it taken from him.

In my state, if you owe more than $ 500 in back support they will take your return automatically. Even if you’re paying back support.
BTW-your kids obviously have already survived without that back payment up until now, why are you being so greedy about it??
